David M. McQuiston

David M. McQuiston

Dave McQuiston has over 25 years of military and civilian experience in various litigation and transactional practice areas.

One of Mr. McQuiston's areas of concentration is healthcare. He has significant experience representing healthcare providers in litigation and in solving various medical-legal problems. He was staff legal advisor for the U.S. Naval Hospital in Puerto Rico for three years where he provided counsel in the areas of risk management, medical malpractice, credentialling and employment-related issues. For the last 14 years, Mr. McQuiston has represented hospitals, physicians, nurses and physical therapists in malpractice cases including those involving alleged misdiagnosis, surgical misadventure, negligent physical therapy, negligent psychiatric care and adverse drug reactions. Additionally, Mr. McQuiston provides counsel to healthcare providers and institutions in areas of risk management, quality assurance and workers' compensation.

Mr. McQuiston chairs the firm's admiralty practice, which for over 30 years has represented numerous admiralty clients as well as marine managers and insurers. He has litigation and transactional experience in numerous areas of maritime practice, including collision, allision, towing, cargo (including freights and demurrage), salvage, insurance and other contracts, personal injuries and death claims and actions, harbor facilities, corps of engineers and Coast Guard.

Mr. McQuiston also represents numerous automobile and trucking clients in complex litigation as well as representing clients in the defense of workers' compensation claims. His practice in these areas encompasses all of Central and Western Pennsylvania, and includes all state and federal courts and administrative agencies.

Mr. McQuiston is a proctor member of the Maritime Law Association (MLA) and a member of the Navigation and Coast Guard Committee, The Recreational Boating Committee and the Stevedore and Terminal Operators Committee of the MLA. He has served  as President and a member of the Board of Directors of the Pittsburgh River Terminal Operators Association. Mr. McQuiston is also an active member of the Waterways Association of Pittsburgh and is currently its Legislative Committee Chairman. As such, he travels each year to Harrisburg and Washington, D.C. to meet with congressmen and senators in the Pennsylvania, Ohio and West Virginia districts impacted by the commerce on the Allegheny, Monongahela and Ohio Rivers to lobby for continued financial support for the state and federally funded lock and dam construction and improvement projects in the upper Ohio River basin. In addition, Mr. McQuiston was appointed by the Governor of Pennsylvania to serve as Commissioner on the Port of Pittsburgh Commission.  Mr. McQuiston is a retired Captain in the Navy Judge Advocate General Corps, having served on active duty from 1980-1985 and as a Reservist from 1988 -2011. He served 4 years as Military Judge of Courts - Martial of the United State Armed Forces as his last assignment.

A cum laude graduate of Allegheny College and a 1980 graduate of the University of Pittsburgh School of Law, Mr. McQuiston is admitted to practice in all state and federal courts in Pennsylvania. In addition, he is a member of the Allegheny County and Pennsylvania Bar Associations. Further, he is also an active participant in such organizations as the Western Pennsylvania Association of Healthcare Risk Management, and the Civil Litigation Section of the Pennsylvania Bar Association.
