Employee Benefits/ERISA

At Thomson, Rhodes & Cowie, P.C., we provide a full range of employee benefit consultation and litigation services. We can assist businesses of all sizes in designing employee benefit plans, including profit sharing, 401(k) and 403(b) plans as well as health and welfare, disability and cafeteria plans.

We also advise clients on Consolidated Omnibus Budget Reconciliation Act (COBRA) and Family and Medical Leave Act (FMLA) compliance issues related to employee benefit plans and can review existing plans for compliance with current laws and regulations. The goal of our employee benefits practice is to help employers establish sound benefit programs that are fully grounded in the myriad of applicable governmental regulations. Among the attorneys involved in these areas is an attorney who is also a Certified Employee Benefit Specialist.

Over the years, we at Thomson, Rhodes & Cowie have been extensively involved in Employee Retirement Income Security Act (ERISA) litigation, and we can assist employers and their insurers in defending claims for benefits under employer severance, pension, golden parachute, health and disability plans. We have also been involved in cutting-edge litigation, defending insurers against bad faith claims in the ERISA arena.
